Welcome to Tavrn (the "Service"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Service") operated by Tavrn, AjaxSelectButtonGames ("we", "us", or "our"). By using the Service you agree to be bound by these Terms.

1. Eligibility

5. Payments and Verified Purchases

We may offer paid services or features (for example, account verification badges) that are processed by our payment provider, Paddle. By making a purchase you agree to pay all fees and taxes associated with that purchase and to the payment provider's terms in addition to these Terms.

Checkout and passthrough: During checkout we may use a server-side passthrough mechanism to associate a payment with your account. Do not attempt to manipulate payment payloads or passthrough values.

Refunds and disputes: Our refund policy is described on the relevant purchase page and/or during checkout. If a refund is required, we will follow the payment provider's refund process. For disputes, please contact support at support@404nerds.com. We will cooperate with Paddle in resolving chargebacks, refunds, or other payment-related disputes.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Tavrn and are protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service except as expressly permitted by us.

7. DMCA and Copyright

If you believe User Content infringes your copyright, please provide a notice containing the information required by the Digital Millennium Copyright Act (DMCA) to our designated agent. Our DMCA takedown policy is available at /dmca (or contact support if not available).

8. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including for violations of these Terms or illegal activity. On termination, your rights under these Terms immediately cease.

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Tavrn and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or use arising out of or in connection with the Service.

You agree to indemnify and hold Tavrn and its officers, directors, employees and agents harmless from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may revise these Terms from time to time. If we make material changes, we will provide notice (for example by email or posting a notice on the site) before they become effective. Your continued use after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Tavrn is organized, without regard to conflict-of-law principles. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
